Terms Of Use

1. Introduction and Acceptance

These Terms of Use (“Terms”) govern your access to and use of Critsy, including Critsy: Cosmic Survival, its mobile applications, game features, online services, virtual items, purchases, subscriptions, and related services.

Critsy is developed and published by Mehmet Alper Alp, an individual developer based in Türkiye (“Developer,” “I,” “me,” or “my”).

By downloading, accessing, purchasing from, or using Critsy, you agree to these Terms.

If you do not agree to these Terms, do not use Critsy.

If you are not legally able to enter into a binding agreement in your jurisdiction, a parent or legal guardian must review and agree to these Terms on your behalf where required by applicable law.

Your use of Critsy is also subject to the rules and terms of the platform through which you obtained the game, including the Apple App Store or Google Play.

2. License to Use Critsy

Subject to these Terms and applicable platform rules, you are granted a limited, personal, revocable, non-exclusive, non-transferable and non-sublicensable license to install and use Critsy for your personal, non-commercial entertainment purposes.

Critsy is licensed, not sold.

Except where applicable law expressly permits otherwise, you may not:

copy, reproduce or redistribute Critsy;
sell, rent, lease, sublicense or commercially exploit Critsy;
modify or create derivative works from Critsy;
reverse engineer, decompile, disassemble or attempt to obtain Critsy's source code;
bypass technological protection measures;
interfere with Critsy's servers, security systems or services; or
use Critsy for any unlawful purpose.

All rights not expressly granted to you remain reserved.

For Critsy obtained through the Apple App Store, Apple's Standard End User License Agreement also applies unless Apple or the Developer expressly provides otherwise.

These Terms govern Critsy's game services, accounts, virtual items, purchases, subscriptions and related features and are not intended to replace Apple's Standard EULA.

3. Game Accounts

Critsy may automatically create a technical anonymous game account using Firebase Authentication when you begin playing.

You are not currently required to provide a real name, email address, password or phone number to create this game account.

Your account may be associated with:

a technical player identifier;
game progress;
scores;
stars;
virtual currency;
virtual items;
purchased entitlements;
subscription status;
cosmetics;
settings; and
other game-related information.

You are responsible for maintaining control of the device and account environment through which Critsy is accessed.

Because anonymous accounts may not be recoverable through conventional email or password recovery, loss of your device, deletion of local data or other technical events may affect account recovery unless relevant progress has been successfully synchronized with Critsy's backend services.

I do not guarantee that every lost anonymous account can be recovered.

4. Game Progress and Cloud Services

Critsy may store certain information locally on your device and may synchronize selected game information through cloud-based services.

Cloud functionality may depend on:

internet connectivity;
Firebase or Google Cloud availability;
Apple or Google services;
device compatibility;
game version;
account status; and
successful synchronization.

You should not assume that all locally generated game data has been successfully synchronized until the relevant server operation has completed.

I may correct game data where reasonably necessary to address:

synchronization errors;
duplicated rewards;
corrupted data;
technical defects;
invalid transactions;
cheating;
exploitation of bugs; or
fraudulent activity.

Any such correction will be made in a manner reasonably related to maintaining the integrity of the game.

5. Virtual Currency, Virtual Items and Game Content

Critsy may provide virtual currency, points, coins, power-ups, cosmetic items, avatars, entitlements, rewards or other digital game content (“Virtual Items”).

Virtual Items may be:

earned through gameplay;
granted as rewards;
obtained by watching eligible rewarded advertisements;
included as part of a subscription or promotion; or
purchased through an authorized app store.

Unless applicable law provides otherwise:

Virtual Items have no real-world monetary value;
Virtual Items cannot be redeemed for cash;
Virtual Items cannot be exchanged outside Critsy;
Virtual Items may only be used within Critsy;
Virtual Items may not be sold, transferred or traded between users unless Critsy expressly provides such functionality; and
purchasing a Virtual Item provides a limited right to use that item within Critsy and does not transfer ownership of Critsy's underlying intellectual property.

Virtual Items are part of the game service and may be subject to game balancing, technical changes and feature updates.

I may modify gameplay-earned rewards, balancing parameters, prices expressed in virtual currency, item effectiveness and game economy rules as reasonably necessary to operate and balance Critsy.

Purchased entitlements will not be arbitrarily removed. They may, however, be adjusted or revoked where the underlying transaction is refunded, reversed, cancelled, fraudulent, invalid or otherwise not successfully completed, or where required by law or the applicable app store.

6. In-App Purchases

Critsy may offer in-app purchases through the Apple App Store and Google Play.

Examples may include:

virtual currency;
virtual items;
cosmetic content;
game features;
Remove Ads;
subscription products; and
other digital content.

All purchases are processed by the applicable app store.

Critsy does not directly collect your complete payment-card information.

The final price, currency, taxes and payment terms displayed by Apple or Google at the time of purchase govern the transaction.

You are responsible for reviewing the purchase information before confirming a transaction.

A purchase is not considered successfully delivered until the applicable store and Critsy's purchase-verification systems recognize the transaction as valid.

Critsy may verify purchase receipts, transaction identifiers, purchase tokens, subscription status and related information to:

deliver purchased content;
restore eligible purchases;
prevent duplicate delivery;
detect fraud;
maintain entitlements; and
validate subscriptions.

If a transaction is refunded, reversed, cancelled or invalidated, the related Virtual Items, benefits or entitlements may also be removed.

7. Remove Ads

Critsy may offer a Remove Ads purchase.

The exact benefits included with Remove Ads are those presented on the applicable purchase screen at the time of purchase.

Unless specifically stated otherwise on that screen, Remove Ads is intended to remove the categories of developer-controlled advertising identified in the offer.

Optional rewarded advertising that a player voluntarily chooses to watch in exchange for a game reward may remain available if this is disclosed as part of the applicable product or game experience.

Remove Ads does not control:

Apple or Google store content;
operating-system content;
external websites;
third-party services outside Critsy; or
content not served as advertising by Critsy.

8. Critsy Club Subscriptions

Critsy may offer an auto-renewable subscription currently known as Critsy Club.

Critsy Club may be offered in different billing periods, including monthly or annual plans.

The exact subscription benefits, billing period and price are displayed before purchase.

Subscription benefits are those described on the subscription purchase screen at the time of purchase and may include recurring or ongoing game benefits.

Automatic Renewal

Unless cancelled, Critsy Club automatically renews at the end of each subscription period according to the terms presented by the Apple App Store or Google Play.

Your applicable store account will be charged according to the price, billing period and renewal terms displayed before you confirm the subscription.

Managing or Cancelling a Subscription

Subscriptions purchased through Apple must be managed through your Apple account and App Store subscription controls.

Subscriptions purchased through Google Play must be managed through your Google Play subscription controls.

Cancelling a subscription generally stops the next automatic renewal. Unless the applicable store rules or law provide otherwise, subscription benefits normally remain available until the end of the already-paid subscription period.

Deleting Critsy or deleting your Critsy game account does not automatically cancel an Apple App Store or Google Play subscription.

You must separately cancel an active subscription through the applicable store.

Changes to Subscription Pricing or Benefits

Subscription prices may change in accordance with the procedures and notice requirements of Apple, Google and applicable law.

If Critsy Club benefits are materially changed, existing subscribers will be treated in accordance with applicable law and applicable store requirements.

I may improve, replace or modify individual subscription features over time as part of the continuing Critsy service, provided that any mandatory rights relating to paid subscription services are respected.

Trials and Promotional Offers

Critsy may occasionally provide free trials, introductory prices or promotional subscription offers.

Where offered, the applicable:

eligibility requirements;
trial duration;
promotional period;
renewal price; and
automatic renewal terms

will be shown before purchase.

Unless cancelled before the applicable renewal point, a trial or promotional subscription may convert into a paid auto-renewable subscription according to the terms shown by the applicable app store.

9. Refunds

Purchases made through the Apple App Store or Google Play are subject to the applicable store's payment and refund systems, policies and applicable law.

If you wish to request a refund, you should normally use the refund mechanism provided by Apple or Google for the relevant transaction.

Nothing in these Terms limits any refund, withdrawal or other consumer right that cannot lawfully be excluded or restricted in your jurisdiction.

If a purchase is refunded or reversed, access to the associated digital content, Virtual Items, subscription benefits or other entitlement may be removed.

10. Advertising and Rewarded Ads

Critsy may contain advertising, including advertising delivered through third-party services such as Google AdMob.

Advertising may include:

interstitial ads;
rewarded ads;
other advertising formats supported by Critsy.

Where available, rewarded advertisements allow you to voluntarily watch or interact with an advertisement in exchange for an in-game reward.

The reward is subject to successful completion and verification of the applicable rewarded-ad event.

Advertising availability is not guaranteed.

A particular ad, advertiser, reward opportunity or advertising format may not always be available.

Advertising practices and personal-data processing are further described in the Critsy Privacy Policy.

11. Online, Competitive and Multiplayer Features

Critsy may provide online features, including competitive gameplay, leaderboards, player profiles, usernames, friends, matchmaking or multiplayer game modes.

These features may be added, modified or removed over time.

Where such features are available:

internet access may be required;
matchmaking times are not guaranteed;
connection quality may affect gameplay;
matches may end because of disconnections or technical problems;
matchmaking rules may change for balancing purposes;
ranking systems may be adjusted;
seasonal or competitive results may be reset; and
availability may depend on the number of active players.

To support matchmaking, onboarding, game balancing, testing or service availability, Critsy may use automated or simulated opponents in certain game modes.

Participation in a competitive or multiplayer mode should therefore not be interpreted as a guarantee that every opponent encountered in every circumstance is a human player.

Critsy may take reasonable steps to maintain competitive integrity.

12. Player Conduct and Fair Play

You must use Critsy fairly and lawfully.

You may not:

cheat or use unauthorized software;
use bots, scripts, macros or automation to play Critsy on your behalf;
modify the game client;
manipulate network communications;
exploit bugs or vulnerabilities for an unfair advantage;
generate or obtain Virtual Items through unauthorized methods;
manipulate purchases, subscriptions or advertising rewards;
falsify transaction information;
interfere with matchmaking or ranking systems;
impersonate another user;
attempt unauthorized access to another player's account;
disrupt Critsy's servers or infrastructure;
use abusive, threatening, hateful, discriminatory or unlawful usernames or user-submitted content where such features are available;
harass other players;
use Critsy to distribute malware, scams or unlawful material; or
assist another person in engaging in any of the above conduct.

Finding a bug does not give you permission to exploit it.

Suspected security vulnerabilities should be reported rather than exploited.

I may investigate suspected cheating, fraud, exploitation or other violations using game and technical records available to Critsy.

13. Usernames, Profiles and Social Features

Where Critsy allows players to create usernames, profiles, avatars or other user-visible information, you remain responsible for the content you choose to submit.

You must not use:

another person's identity without authorization;
unlawful content;
obscene or severely offensive content;
hate speech;
threats;
harassment;
sexually exploitative content;
content that infringes intellectual-property rights; or
content intended to deceive, scam or harm other users.

Critsy may remove, restrict or modify access to user-submitted content or social features where reasonably necessary to enforce these Terms, comply with platform requirements, protect users or comply with law.

Where required by the nature of a social feature or applicable platform rules, Critsy may provide reporting, blocking or moderation tools.

14. Suspension and Termination

I may restrict, suspend or terminate access to some or all Critsy services where reasonably necessary because of:

material violation of these Terms;
cheating;
fraud;
abuse;
manipulation of purchases or Virtual Items;
security threats;
unauthorized modification of Critsy;
unlawful activity;
repeated harmful behavior toward other users; or
a legal or platform requirement.

Where appropriate and reasonably practicable, the action taken will be proportionate to the violation.

Severe fraud, security attacks or deliberate exploitation may result in immediate restriction or termination.

Termination caused by a violation of these Terms does not create a right to compensation for gameplay-earned Virtual Items.

Any rights you have relating to paid content remain subject to applicable consumer law and the applicable store's rules.

You may stop using Critsy at any time.

You may also request deletion of your Critsy account as described in the Privacy Policy and Critsy's account-deletion information.

Account deletion does not itself cancel an active App Store or Google Play subscription.

15. Updates, Balancing and Changes to Critsy

Critsy is an evolving game.

I may provide updates that:

add levels;
remove or replace content;
introduce new game modes;
change gameplay mechanics;
rebalance difficulty;
rebalance rewards;
change virtual-currency costs;
change power-ups;
modify matchmaking;
update graphics or interfaces;
improve security;
fix defects;
improve performance; or
maintain compatibility with platforms and devices.

Game balancing is part of the normal operation of Critsy and does not guarantee that a particular gameplay strategy, reward rate, item effectiveness or level configuration will remain unchanged indefinitely.

Updates may be required to continue using some online features.

I do not guarantee indefinite compatibility with every operating-system version, device or hardware configuration.

Material changes affecting paid services will be handled in accordance with applicable law and app-store requirements.

16. Service Availability

I aim to keep Critsy available and functional but do not guarantee uninterrupted or error-free operation.

Critsy may temporarily become unavailable because of:

maintenance;
updates;
server failures;
cloud-service outages;
app-store outages;
network failures;
cybersecurity incidents;
technical defects;
force majeure events; or
circumstances outside my reasonable control.

Online functionality, cloud synchronization, advertising, purchase verification and multiplayer features depend partly on third-party services.

To the maximum extent permitted by law, temporary service interruption alone does not create a right to compensation.

This does not affect mandatory rights that apply to paid digital services.

17. Discontinuation of Features or the Game

I may discontinue an individual feature, game mode, online service or Critsy itself where reasonably necessary for technical, commercial, security, legal or platform-related reasons.

Where discontinuation materially affects an active paid subscription or other continuing paid entitlement, I will follow applicable law and the requirements of Apple or Google concerning existing users.

Where reasonably practicable, advance notice of material service discontinuation will be provided.

18. Intellectual Property

Critsy and its contents are protected by intellectual-property laws.

Unless otherwise identified, all rights in Critsy belong to the Developer or applicable licensors, including rights relating to:

software;
source code;
game mechanics as protectable by law;
artwork;
characters;
character designs;
animations;
visual assets;
music;
sound effects;
text;
logos;
names;
graphical interfaces;
level designs;
databases; and
other original content.

The Critsy name, characters and associated branding may not be used in a way that suggests authorization, sponsorship or affiliation without permission.

Nothing in these Terms transfers Critsy's intellectual-property rights to you.

19. Feedback

If you voluntarily provide suggestions, ideas or feedback about Critsy, I may use that feedback to improve Critsy without an obligation to pay compensation, provided that doing so does not transfer ownership of unrelated material you own.

Do not submit confidential information through general feedback channels.

20. Third-Party Services

Critsy relies on third-party platforms and service providers, which may include Apple, Google, Firebase, Google Cloud, Google AdMob and other infrastructure providers.

Your use of those services may also be subject to their respective terms.

I am not responsible for independent third-party services to the extent they are outside my reasonable control, subject always to rights and responsibilities that cannot lawfully be excluded.

21. Privacy

Critsy's processing of personal data is described separately in the Critsy Privacy Policy.

By using Critsy, you acknowledge that you have been provided access to the Privacy Policy.

Consent for processing that legally requires consent is requested separately where necessary and is not created merely by accepting these Terms.

22. Disclaimer of Warranties

To the maximum extent permitted by applicable law, Critsy is provided on an “as available” basis.

While reasonable efforts are made to maintain and improve the game, I do not guarantee that:

Critsy will always be available;
Critsy will be completely free of bugs or technical errors;
every device will provide identical performance;
cloud synchronization will never fail;
matchmaking will always find another player;
every online match will complete successfully; or
every third-party service will remain continuously available.

Nothing in these Terms excludes statutory warranties, guarantees or consumer rights that cannot legally be excluded.

23. Limitation of Liability

Nothing in these Terms excludes or limits liability where such exclusion or limitation is prohibited by law.

In particular, these Terms do not exclude liability for fraud, intentional misconduct, gross negligence, or death or personal injury where applicable law does not permit such liability to be excluded.

To the maximum extent permitted by law, I am not liable for indirect, incidental, special or consequential losses arising solely from the use or inability to use Critsy, including loss caused by:

temporary service interruptions;
unsupported device configurations;
internet connectivity;
independent third-party service failures; or
loss of unsynchronized local game progress.

To the maximum extent permitted by applicable law, any aggregate liability arising directly from Critsy will not exceed the amount you paid for Critsy products or services during the twelve months immediately preceding the event giving rise to the claim.

This limitation does not apply where applicable consumer or other mandatory law requires a different remedy or liability standard.

24. Mandatory Consumer Rights

These Terms are not intended to remove rights granted to you by mandatory consumer-protection law.

If the laws of your country provide rights that cannot legally be waived, those rights remain fully applicable.

Where a provision of these Terms conflicts with a mandatory consumer right, the mandatory rule applies to the extent of the conflict.

25. Apple App Store Users

If you obtain Critsy through the Apple App Store:

your use of the application is also subject to Apple's applicable App Store terms and Standard End User License Agreement;
Apple processes App Store purchases and subscriptions under its own terms;
Apple is responsible for the App Store payment system and account-level subscription management provided by Apple;
Critsy's developer remains responsible for the operation and support of Critsy to the extent required by applicable law and Apple's rules; and
nothing in these Terms modifies rights or obligations that Apple requires to apply to applications distributed through the App Store.

No custom Critsy EULA is intended to replace Apple's Standard EULA unless expressly stated through App Store Connect.

26. Google Play Users

If you obtain Critsy through Google Play:

your use of Google Play is subject to Google's applicable terms;
Google Play processes applicable in-app purchases and subscriptions through its billing system where required;
Google controls account-level Google Play payment and subscription-management functionality;
purchased Critsy virtual currency is intended for use only within Critsy;
subscription pricing, renewal information and billing terms are displayed before purchase; and
nothing in these Terms overrides mandatory Google Play policies or applicable consumer rights.

27. Governing Law

These Terms are governed by the laws of the Republic of Türkiye, without regard to conflict-of-law principles, except where mandatory law applicable to you requires otherwise.

If you are a consumer, nothing in this section deprives you of mandatory protections or rights available under the laws of your country of residence.

Any dispute that cannot be resolved informally will be handled by the courts or competent authorities having jurisdiction under applicable law.

28. Changes to These Terms

These Terms may be updated to reflect:

new Critsy features;
changes to purchases or subscriptions;
platform requirements;
legal requirements;
security requirements; or
changes in how Critsy operates.

The latest version will be published on the Critsy website.

Material changes will be communicated where required by law.

If applicable law requires renewed agreement or consent for a particular change, the required process will be used.

Continuing to use Critsy after a non-material update takes effect constitutes acceptance of the updated Terms to the extent permitted by law.

29. Severability

If a provision of these Terms is found to be invalid or unenforceable, that provision will be applied to the maximum extent legally permitted or, where necessary, removed.

The remaining provisions will continue in effect.

30. No Waiver

Failure to enforce a provision of these Terms on one occasion does not constitute a permanent waiver of that provision or any other right.

31. Entire Agreement

These Terms, together with the Critsy Privacy Policy and applicable Apple App Store or Google Play terms, form the applicable agreement concerning your use of Critsy, except where additional terms are expressly presented for a particular feature, promotion or purchase.
